Administrative Policy #10.06 - Locally Regulated Building Activities

Purpose

The Community Development Department's Development Services Division enforces the Oregon Building Codes, as adopted by the Consumer and Business Services: Building Codes Division (BCD) through ORS 455. With the adoption ofthe20l9 Oregon Structural Specialty Code (OSSC), BCD removed several activities from statewide regulation. Regulating these activities is a local decision, as Section 101.2 of the 2019 OSSC allows municipalities to enact a local ordinance to regulate these activities. City Council has enacted a local ordinance that permits the City to adopt this Administrative Policy to regulate several activities permitted under Chapter I of the OSSC.

Scope

This Policy identifies the activities that have been removed from the statewide building code and the City will continue to regulate through the City Development Services permitting and inspection program.

Policy

Pursuant to ORS 455.020(4) and adopted by local ordinance, the scope of the State Building Code has been amended to include the following local requirements and shall be permitted and inspected pursuant to the City's Municipal Code and the State Building Code.

  1. Chapter 32 of the Oregon Structural Specialty Code, titled: Encroachments into the Public Way. This oversight is in addition to, and different from, general approvals from the Public Works Department for an encroachment to occur.
  2. Free standing, pole mounted, and other signs not attached to or supported by regulated building.
  3. Retaining walls that are over four feet (1219 mm) in height measured from the bottom of the footing to the top of the wall or any retaining wall supporting a surcharge.
  4. Ground mounted flagpoles, antennae, or similar items that exceed 25 feet in height.
  5. Cellular phone, radio, television and other telecommunication and broadcast towers that are not attached to or supported by a regulated building.
  6. Tanks located exterior to and not attached to or supported by a building and having a capacity that exceeds 1,000 gallons (3785 L); having a ratio of height to diameter that exceeds 2 to l; or containing a hazardous or flammable material.
  7. Fences and walls over seven feet in height.
  8. Chapter 33 of the Oregon Structural Specialty Code, titled: Demolitions.

Procedures

The activities identified in this Policy are reviewed and permitted by Development Services in accordance with Title 9 of the Municipal Code. Permit fees are calculated based upon the fee methodology identified in Chapter 8.03 of the City's Municipal Code. 

Review/Update

The Community Development Director will prepare this Administrative Policy for review as needed and it will be reviewed and approved by the City Manager.
