Administrative Policy #10.01 - Carnivals, Procedure & Guidelines for License Approval
Purpose
To establish procedures for approval of licenses for carnivals.
Scope
This policy applies to any Class I or Class II Carnival, as defined in the “Definitions” section below, proposed within the Corvallis city limits.
Policy
The operator of any Class I or Class II Carnival proposed within the Corvallis city limits shall apply for and receive the appropriate license as set forth herein.
Procedures
Filing Deadlines: Complete applications for a license to operate a carnival must be filed with the Community Development Department at least 30 days before the first day of operation.
Application Materials: Applications for licenses shall include the following information where applicable:
- Completed application form, including original written signature(s) of the property owner(s)
- Site plan drawn to scale showing
- All structures (including any temporary and/or permanent tents or other membrane structures)
- Tent/membrane structure setbacks from property lines
- Separation distances between tent/membrane structures and other tent/membrane structures, buildings, and/or vehicle parking areas
- Amusement ride locations
- Concession areas, and separation distances between concession areas and amusement rides and/or dwelling units
- Restroom facilities
- Refuse collection areas
- All vehicle parking, maneuvering, and/or loading areas
- Emergency vehicle lanes and access
- Fire hydrants (non-potable water source)
- Proposed water sources (potable and non-potable)
- Proposed power sources
- Proposed temporary light sources
- The relationship of the site to adjoining properties, streets, alleys, structures, and other physical features
- Details showing anchorage for any proposed tents or membrane structures
- Any additional information necessary to document compliance with Oregon Fire Code requirements
- Verification of insurance (see below)
- Fees and deposit as required (see below)
Fees and Deposit: The following fees and deposit are to be paid at the time of application for a permit:

* The deposit shall be refundable to the applicant following the term of the license if no damage has occurred to City property, if no cleanup activities in the public right-of-way are required, and if no staff time is expended resolving valid complaints related to the carnival activities. Complaints are determined valid if it is found the permittee has violated a condition of the permit or other code or ordinance. Costs for damages, cleanup, or staff time will be deducted from the deposit, and the remainder of the deposit, if any, will be refunded to the applicant. Costs in excess of the deposit shall be immediately due and payable from the applicant. Failure of an applicant to pay any excess costs shall be cause for denial of future permit requests. Staff time for addressing valid complaints will be charged at the rate of $60.00 per hour up to the amount of the deposit.
Insurance Requirements: Each application for a Carnival, Class I or II, shall include a certificate of insurance naming the City of Corvallis as an additional insured, which provides $2,000,000 combined single-limit commercial general liability coverage for each occurrence. The certificate shall specify that no change to the coverage shall occur without a minimum of 30 days notice to the City. Each applicant for a Class I or Class II Carnival shall also supply the City with proof of workers’ compensation coverage as required by law.
No application for a Carnival license shall be processed until all insurance requirements have been met.
Guidelines
Conditions and Additional Permit Requirements: The following conditions and permit requirements must be met for approval of the application:
- A Class I Carnival shall not be located within a residential zone.
- The carnival shall not displace code-required vehicle parking or maneuvering areas, nor inhibit required ADA access.
- The application shall demonstrate compliance with all applicable Oregon Fire Code requirements.
- Any proposed tents, air-supported or other membrane structures shall be reviewed and approved by the Fire Department.
- Exterior lighting shall be directed away from residential areas.
- Concession stands utilized for cooking shall have a minimum of 10 feet of clearance on two sides and shall not be located within 10 feet of amusement rides or devices or within 100 feet of a dwelling unit. All cooking oil and food preparation wash must be properly disposed of in approved containers.
- On-site restroom facilities shall be provided.
- Electrical permit approved, if applicable.
- Hydrant permit approved and water meter deposit, if applicable.
- Any required Sound permit, Special Event License, and/or Parade Permit has been approved by the Police Department.
- A plan for trash and garbage disposal shall be provided. Depending on the scale of the event, the franchised solid waste collection company may be required to review and approve.
- Hours of operation may be limited based on site characteristics and the potential for disturbance of residents and businesses in the area.
- Fire extinguishers shall be provided in all food preparation booths and within 75 feet of each ride.
- A 40BC-rated dry chemical fire extinguisher shall be provided where deep-fat fryers are in use.
- Compressed gas cylinders shall be chained securely.
- No open flames are permitted in or immediately adjacent to tents.
- If any food items will be sold, the applicant shall obtain a Temporary Restaurant License and Food Handler’s Card from the Benton County Health Department.
- Any other conditions that may be necessary to minimize the negative impacts of the proposed activity on the surrounding area and the community.
Responsibility
Review of Applications: The Development Services Manager shall distribute copies of the application to affected agencies for their review and comments. Agency review responsibilities are set forth below. Agency comments shall be forwarded to the Development Services Manager within 10 working days of the date the application was distributed. The Development Services Manager shall then compile and forward agency comments to the City Manager, who will approve the application, approve the application with conditions, or deny the application.
In no case shall an incomplete application be processed. The 30-day review period begins upon receipt by the Development Services Manager of a complete application.
Reviewing Agency Responsibilities: Review responsibilities shall be distributed among City agencies as follows:
- Development Services
- Receive application
- Collect fees and deposits
- Coordinate agency review
- Verify compliance with zoning, setback/clearance, parking, and lighting requirements
- Review any proposed use of City utilities
- Compile and forward agency comment to City Manager
- Fire
- Ensure emergency vehicle access is provided as necessary
- Review plans for compliance with Oregon Fire Code requirements (tents and membrane structures, etc.
- Police
- Sound permits, Special Event License, Parade Permits, as necessary
- Identify any traffic safety or security concerns
- Risk Management (Finance)
- Verify insurance coverage
- Parks and Recreation
- Review all plans if proposed in City-owned park, sound permits, special use permits, and associated fees.
- Benton County Health Department
- Temporary Restaurant License and Food Handler’s Card (for sale of food items).
- City Manager
- Approval, approval with conditions, or denial, of the application
Definitions
Amusement Ride: Any vehicle, boat, or other mechanical device moving upon or within a structure, along cables or rails, through the air by centrifugal force or otherwise, or across water, that is used to convey one or more individuals for amusement, entertainment, diversion, or recreation; includes such devices commonly known as Ferris wheels, carousels, roller coasters, and merry-go-rounds.
Carnival, Class I: More than four amusement rides.
Carnival, Class II: Four or fewer amusement rides.

The Community Development Director will update this Administrative Policy as needed for City Manager approval.
